The purchase and the possession of a ski pass includes the full knowledge and acceptance of these rule of transport and the conditions of sale.
Art. 1 - GENERAL RULES -
The mountain environment in which you are located and the changing natural or artificial conditions that characterize it, as well as the practice of skiing and / or snowboarding, constitute a risk inherent in the very nature of the activity. The purchase of the ticket and the use of the facilities imply the knowledge of such eventualities and the acceptance of all the conditions foreseen in the present conditions of sale.
It will not be possible for customers to claim compensation for accidents resulting from accidents caused by one of the following assumptions, which are given by way of example: change in weather conditions, changes in slope of terrain, snow conditions (icy, wet, etc.). ), ground surface conditions (non-snowy points, stones, bumps, branches or holes), impact with the structures of the lifts, collision with other skiers, imprudence of the skier or race on closed ski runes and / or off tracks.
Art. 2 - EXERCISE PERIOD -
The start and end of the winter season is fixed at discretion of our company, established under the climatic conditions, the condition of the slopes, snowmaking and technical needs of maintenance of the ski facilities. When it is imposed by mandatory technical requirements and / or by force majeure, the activity may be suspended at any time, in whole or in part. The above also with reference to the provisions of the "D.M. March 8, 1999 - Special technical requirements for single-lifter cableways with continuous unidirectional movement and temporary connection of vehicles - ".
Art. 3 - EXERCISE CALENDAR -
The operating hours of the ski facilities are established by our company and brought to the attention of the public through notices published at the ticket offices and at the stations of departure and arrival of the plants. For technical, service, safety and / or force majeure reasons, this timetable may change, even without notice, during the day.
Art. 4. - PLANT OPERATIONS -
The number and type of ski facilities to be put into service will be established by our company on a daily basis and may undergo changes during the day, even without notice, due to technical, service, safety and / or force majeure requirements.
Art. 5 - METHOD OF USING THE SKI FACILITIES-
a. Users must make use of the systems observing maximum diligence and attention so as not to constitute danger for themselves or for others.
b. The ski facilities must be used in compliance with the provisions of the law, observing in particular with the utmost care all the requirements and indications indicated on the appropriate signs or notices placed in the stations and on the layouts of the plants.
c. Users will be required to compensate all direct and indirect damages caused by their fault or malice to persons, installations or things owned by our company and third parties.
d. In the event of adverse weather conditions (strong wind or persistent gusts), the service may experience slowdowns or suspensions and, as a consequence, the user must be aware that the time taken for the ascent can also increase significantly. The above also with reference to the provisions of the "D.M. March 8, 1999 - Special technical requirements for single-lifter cableways with continuous unidirectional movement and temporary connection of vehicles - ". The transport service will also be suspended, if atmospheric conditions occur which affect the safety of the operation, or wind with a noticeably high intensity or gusts that may cause dangerous oscillations for vehicles or for ropes. For this reason, constituting cause of force majeure, the cost of purchasing the ticket or the ski pass can not be reimbursed
e. Taking into account that the use of chairlifts and surface lifts presupposes that the user is predisposed and / or able to practice sports, in addition to possessing the requisites of adequate physical fitness, it is forbidden to those who are not, even only temporarily, in the aforementioned suitable conditions to make use of such plants. Therefore, our company reserves the right to inhibit the use of facilities to persons who due to their obvious inability such as mutilation, physical or mental conditions, state of drunkenness and other reasons do not seem able to use it without danger.
f. It is forbidden to transport things, materials and equipment other than those strictly necessary for the exercise of authorized sports practices in the ski area; therefore our company does not assume any responsibility for damage, destruction or removal of things admitted to transport, whether or not they are in the possession of the person transported. It is also generally forbidden to transport people on foot, except in exceptional cases authorized by the Management.
g. In the case of accidents, injuries or when you detect dangerous situations or simply to prevent them, or if the person concerned is not in condition to do so, all those who have knowledge must immediately report the fact to the personnel in charge so that all the opportune measures can be arranged as soon as possible.
h. It is strictly forbidden to make use of the ski facilities, even when the are moving, when there are signs of a closed system and, when access to the starting points is closed to the public and is not monitored by the appropriate control staff.
i. Those who contravene the above rules will be held responsible for all the consequences and direct or indirect damages caused by them.
Art. 6 - METHOD OF USING THE SLOPES -
a. The beating of the ski slopes is made in the times and in the ways established by our company at its sole discretion.
b. The tracks closed for technical or safety reasons are indicated with appropriate signs and it is forbidden to travel.
c. The rescue service only monitors open and marked ski slopes.
d. Each skier is required to observe the signs along the ski slopes.
e. Our company is not responsible for accidents that may occur in off-ski routes even if served by the ski fcilities themselves.
f. It is forbidden to cross the ski slopes with equipment other than skis, monoski and snow boards.
g. It is strictly forbidden to use sleds or motorized vehicles and ski-bobs of any kind, even with closed tracks. The violators will have to answer for possible damages to the surface of the tracks and of the most serious damages eventually caused to the skiers.
h. It is forbidden to walk the ski slopes, except in cases of urgent necessity. Those who cross the ski slope must remain at the edges, taking care to avoid risks to the safety of skiers.
i. The classification of the ski slopes according to their degree of difficulty - black, red and blue - is indicative of the difficulties that they present, so the skier must judge whether his expertise allows him to use it without suffering or causing accidents. In any case, the skier must keep a course that, in relation to the characteristics of the track and the environmental situation, does not constitute a danger for his own and others' safety.
j. The artificial snow-making system could be in operation on the ski slopes, and could also be present on the snow groomer tracks or service snowmobiles. Skiers must give priority to the mechanical means used for the service and maintenance of the ski slopes and facilities and must allow their smooth and rapid circulation.
k. All children under 18 have the obligation to use a protective helmet - Law February 28, 2021 -n. 40 - art. 17. The person responsible for the violation of the provision is subject to an administrative penalty ranging from 100 to 150 euros.
l. The transport on the chairlifts of unaccompanied children is allowed only if they have exceeded 125 cm. Children under 125 cm in height, to be able to travel unaccompanied on the chairlifts must prove to be 8 years of age (DM: 10.04 .84); with the purchase or acceptance of ski passes for children, the accepting signer assumes all the responsibilities related to the use of the ski lifts and slopes by the minor beneficiary, who will use them under the direct supervision of the signer, who declares and signs be aware of the conditions of sale.
Art. 7 - RACES AND EVENTS-
a. During competitions or events, our company reserves the right to close to the public certain routes, slopes, areas and facilities necessary for their regular execution, for the time necessary for their execution. In such circumstances, certain ski facilities may be used exclusively or as a priority for the athletes and the personnel concerned.
b. For all races or events of any kind, our company is limited to making available to the organizers equipment and materials owned, without however taking on any responsibility or burden both towards the participants and third parties. The organizers will therefore bear the obligation to prepare all appropriate measures to ensure the smooth running of the competitions and events, reducing to the strict minimum and for the shortest possible time the limitations that must be imposed on normal users.
c. In the event of third party organization of any operation or service, the liability of our company is strictly limited to the sole operation of the ski lifts, remaining any other responsibility for the organizers.
Art. 8 - RATES AND TICKETS -
a. All rates are - as a rule - applicable for the entire season of competence. They may, however, be modified at any time when particular significant changes in the cost of ski facilities managing occur.
b. Tickets, online tickets and vouchers are valid for the season durate. Tickets validity can be not progate and no refound can be made.
c. The purchase of the ticket gives only the right to use the corresponding facilities, for the rates indicated, on the day or days of validity provided and according to the normal order of influx of travelers to the departures of the ski facilities.
d. The customer must check, at the time of the withdrawal of the ticket or skipass, the correspondence of the same to his request. In fact, it is not possible to change the duration of the cards already purchased afterwards.
e. There is no refund or even partial compensation in the event of waiting times for access to the systems, due to any reason, or in case of interruptions in the operation due to technical or atmospheric causes, or for failure to use the facilities due to of events that are not attributable to the gross negligence of our society.
f. The tickets are to be used on the ski facilities in operation at the time of their use and do not give right to reimbursements or compensation of any kind in the event that one or more systems are not in operation for technical needs established by our company, at its sole discretion, or due to force majeure.
g. When the transport is carried out without payment, it is intended as a donation and is therefore made without any commitment or responsibility.
h. All tickets are strictly personal and non-transferable. Any abuse will result in the immediate withdrawal of the ticket and the application of the statutory penalties.
i. The ticket, also valid as a receipt, must be kept for the entire duration of the transport. The Customer is obliged to keep the skipass in good condition and therefore the person who has lost or seriously damaged it has no right to any refund of the deposit or any replacement by the Company.
j. In case of loss of the Seasonal Skipass an immediate complaint must be made to the company Maniva Ski and to the Carabinieri Command of Collio V.T. or Bagolino; the skipass can be deactivated, blocked and re-issued by paying a "penalty" of € 30.00.
Art. 9 - TARIFF FACILITIES -
a. All non-ordinary rates, that is, all those that enjoy special benefits related to residence, age or other reasons, can be applied only on presentation of suitable documentation proving unequivocally the existence of the requisites required to enjoy the benefit themselves.
b. Pre-established groups must be composed of at least 20 paying people, a free card for the manager is included in the price. The presentation of the list of participants on group headed paper is required. Each component must be equipped with a document or a photo ID to be applied to the skipass. The group discount can not be combined with other discounts.
Art. 10 - CONTROLS -
a. Travelers must obtain the prescribed travel document before using the facility. Tickets found irregular or found not in possession of the right will be immediately and permanently withdrawn, without prejudice to the application of administrative and penal sanctions provided for by law.
b. The documentation certifying the right to reduced rates, may be requested, as well as to the ticket office, also by the personnel in charge of checking the plants or by the company's inspectors.
Art. 11 - FURTS OR LOSS -
No type of ticket is refunded, even partially, if the purchaser can not use it for any reason. Likewise, no refunds or replacements are made in the event of loss, destruction or deterioration, with the exception of impaired but still identifiable tickets which must be presented to the ticket office to be substituted.
